Clerks (1994)
He is not legally divorced, he did not know…?
Our friend received divorce papers in 1994 from his ex who started the action for the divorce…. He read that if he didnt sign the divorce defaults which becomes a legal divorce…. Whatever he read he made a mistake because he had to sign … She never bothered and never took action to finalize papers…
He went on to remarry a few years later and him and his wife are married. The ex wife told them a few years ago that they are not legally divorced …
He did not know and is upset with this and wants to correct it.
Our friend (his wife) contacted the county clerks office and they said to start over …. Can he start the process or he should just take the action of divorce in 94 and proceed with this?
Any suggestions???
Interesting as it seems you counties clerk office dropped the ball on this one. They should have checked when he attempted to remarry. Anyway, see if your friends can find the original divorce decree. I’m not sure if there is a statue of limitations but you might want to check.
